 Latest CCPA Crackdown: Café Blue Bottle & China Gate Fined for Mandatory Service Charge

The fight against the illegal "Service Charge" just got stronger.

In a decisive move that reinforces consumer sovereignty, the Central Consumer Protection Authority (CCPA) has taken suo motu cognizance against 27 restaurants across India for violating consumer rights. This latest action, detailed in the Press Information Bureau release dated January 10, 2026, sends a clear warning to the hospitality industry: Compliance is not optional.

At PRAN, we have consistently argued that "default billing"—where a service charge is automatically added to your bill—is a violation of the Consumer Protection Act, 2019. The authorities agree.

The New Enforcement Actions

The CCPA’s action follows the Delhi High Court judgment (March 28, 2025), which upheld the guidelines stating that service charges are strictly voluntary. The CCPA has now moved from warnings to penalties, triggered by consumer complaints on the National Consumer Helpline (NCH).

Two specific cases highlight this shift:

  1. Café Blue Bottle, Patna:

    • The Violation: Automatically levying service charge.

    • The Penalty: The restaurant was directed to refund the amount to the consumer, discontinue the practice immediately, and pay a penalty of ₹30,000.

  2. China Gate Restaurant (Bora Bora), Mumbai:

    • The Violation: Default addition of a 10% service charge in the software.

    • The Penalty: The restaurant refunded the charge during the hearing. They were directed to modify their billing software to remove the default addition and paid a penalty of ₹50,000.

Why This Matters for You

The CCPA has classified the mandatory levy of service charge as an "Unfair Trade Practice" under Section 2(47) of the Consumer Protection Act.

As a consumer, you must know your rights as defined by the July 4, 2022 Guidelines:

  • No Default Addition: Restaurants cannot add service charge automatically to the food bill.

  • No Hidden Names: It cannot be collected under any other guise.

  • Strictly Voluntary: You cannot be forced to pay it.

  • No Entry Barriers: Refusing to pay cannot be grounds to deny you entry or service.

  • No GST on Tips: Service charge cannot be added to the bill total and then taxed under GST.

PRAN’s Call to Action

We urge all citizens to remain vigilant. The penalties imposed on Café Blue Bottle and China Gate prove that complaints work.

What you should do:

  1. Check Your Bill: Always scan for the "Service Charge" component.

  2. Refuse to Pay: If it is added without your consent, ask for it to be removed.

  3. Report Violations: If the restaurant insists, keep the invoice and lodge a complaint on the National Consumer Helpline (Call 1915) or via the NCH App.
