 Bihar Café Fined ₹30,000 for Auto Service Charge — CCPA Delivers a Hot Plate of Justice!

A café in Patna just paid the price for a habitual “extra topping” no one ordered — automatic service charge. The Central Consumer Protection Authority (CCPA) fined the café ₹30,000 for slipping service charge into every bill without customer consent.

A small charge for them, but a big win for consumers.

The Unappetizing Practice That Triggered Penalty

CCPA’s investigation found that:

  • Service charge was added automatically by the billing system

  • Customers were not informed

  • “Refunds” were issued as credit notes, not actual money

  • The practice amounted to unfair trade practice

CCPA made it clear: Consent-based charges only. No auto-add. No tricks.

Understanding CCPA: The Consumer Watchdog

The Central Consumer Protection Authority (CCPA), created under the Consumer Protection Act, 2019, has powers to:

✔ Investigate unfair trade practices
✔ Order refunds
✔ Impose penalties
✔ Conduct inquiries
✔ Protect consumer rights nationwide

This case shows CCPA is actively monitoring and acting against deceptive billing practices.

How Consumers Can Take Action

1. Raise the Issue with the Restaurant

If service charge is added without consent: → Ask them to remove it. They must.

2. File a Complaint with CCPA (Directly)

Consumers can approach CCPA for unfair trade practices through:

  • Written complaints

  • Email submissions

  • Online filing on the CCPA portal
    (Depending on the latest platform availability)

CCPA handles regulatory violations not individual complaints, including forced service charges.

3. Use National Consumer Helpline (NCH) for Grievance Support

NCH is NOT CCPA. It is a facilitation and guidance platform, not a regulatory authority.
But it helps consumers by:

  • Recording grievances

  • Advising next steps

  • Providing contact escalation

  • Forwarding concerns to businesses for resolution

NCH is useful, but CCPA has the enforcement power.

4. File a Case in Consumer Commission

If loss, harassment, or refusal continues:

  • District Commission (up to ₹50 lakh)

  • State Commission (₹50 lakh–₹2 crore)

  • National Commission (above ₹2 crore)

Even small billing disputes are maintainable.
